SAN FRANCISCO ??Neither side in a bitter patent battle is satisfied with Apple's $1 billion jury verdict over Samsung after a three-week trial this summer.
Samsung wants a new trial. Apple is seeking an additional $707 million in damages and interest.
The two companies filed a blizzard of legal papers late Friday and early Saturday with their demands that a federal judge in San Jose significantly amend ? or toss out altogether ? the jury's Aug. 24 verdict.
The jury found that 26 Samsung products ripped off Apple's technology at the heart of its iPhones and iPads.
"Samsung made a calculated business decision to copy the industrial designs, graphical user interfaces, and touchscreen navigation technology of the iPhone and iPad," Apple lawyers wrote in court papers, arguing for the additional damages. "Samsung has reaped extraordinary rewards from its wrongful sale of iPhone and iPad clones by taking market share, revenues, and profits from Apple."
The Apple lawyers contend that the "massive damage to the iPhone's distinctive product identity caused by Samsung's sale of millions of iPhone clones is irreversible."
U.S. District Judge Lucy Koh has scheduled a Dec. 6 hearing to discuss the myriad issues raised by both companies. Samsung says it will appeal if Koh turns down its demands.
The two companies are locked in a ferocious struggle for supremacy in the global smartphone market. Samsung is the worldwide leaders in smartphone sales, securing a market share of 33 percent in the second quarter, up from 17 percent a year ago. Apple's fell slightly to 17 percent, from 19 percent a year ago.
Apple accuses Samsung of essentially selling knockoffs of the Cupertino-based company's iPhones. Apple filed a lawsuit in San Jose federal court, alleging patent infringement. It was the latest legal action between the two companies, who are battling in courts in 10 countries over smartphone technology.
On Friday, Samsung asked the San Jose judge for a new trial. The company's lawyer argued that the jury's verdict was unreasonable and unsupported by the testimony and evidence. The company's lawyers also complained that the judge's strict constraints on the number of witnesses and testimony time deprived it of a fair trial.
"The Court's constraints on trial time, witnesses and exhibits were unprecedented for a patent case of this complexity and magnitude, and prevented Samsung from presenting a full and fair case in response to Apple's many claims," the company's lawyer wrote in court documents.
Representatives of both companies couldn't be reached for comment.?

When is it practical refinancing your mortgage loan? A simple yes or no to answer whether or not your mortgage loan must be refinanced is not possible. Just think about your property investing business for an instant. Whenever you come across a deal, do you make a simple yes or no final choice about purchasing an investment property without having careful consideration? For the sake of your financial well-being, I hope you do not.
Just like any real estate investment deal, the dilemma of would it make sense to refinance is determined by a number of circumstances. And as with any real estate investing prospect, some of these loan refinancing scenarios are not very advisable. Quite a few deals involve a ?maybe yet only if? answer and, needless to say, some deals are absolute no-brainers.
Let?s take a look at a couple of these cases and I?ll give you my advice on how to deal with the predicament of whether refinancing your loan is a good idea or the opposite. To start with, let?s look at debt. Should you settle debts by adhering to conventional advice through refinancing at a lower rate? For me, this is a deal breaker. Don?t do it. You?re better off making use of other people?s money to clear out debt (i.e. your month to month revenue from tenants in your rental properties.)
Up next, to help you cover rehab or remodel costs, should you refinance a loan? Even though I am against for it on this particular scenario, I wouldn?t call this one a deal breaker. In today?s market, you shouldn?t have any problem purchasing real estate investment properties well beneath market value. This is exactly why your final offer price should include these repair costs.
The only actual way refinancing receives a slight nudge closer to a yes is it if will be your private residence, you intend on residing at the house for many more years, and you want to improve your standard of living. Nevertheless, it is still a very minor nudge towards yes. Don?t forget that, you still must consider all the numbers and costs before continuing to move forward with the refinance.
Finally, does it seem sensible to refinance a loan if the purpose is to reinvest in more cashflow properties? I would most certainly agree to refinance the loan on this one scenario. Then again ? yes there?s a catch ? this scenario only is smart in certain situations. Also, you need to do your homework much like any property investing deal.
Do your due diligence and ask yourself if the investment can pay you more than the cost of the refinance. So make sure your costing is correct. Will this remortgage not cost you money and rather make you money? My reply is a yes if the answer is yes.
You must steer clear of getting caught up in all the buzz about low refinance rates. It does not seem sensible to refinance your loans nine out of ten times. And the one occasion it does seem sensible, you must be using that extra income to acquire more cash flowing assets.

Internet firms also face an array of new obligations to monitor their services for extremist material, according to a document about the "Clean IT" initiative seen by The Telegraph.
?It must be legal for police officers to ?patrol? on social media. This includes having a profile, joining user groups, sending and receiving messages, on the platform," the document says.
Officials are also preparing proposals for ?semi automated detection? systems and buttons to allow users to report suspicious activity on social networks and chatrooms to authorities.
?Users must be provided a way to flag/report terrorism and radicalising content as a separate, specific category to flag/report,? the report, produced last month, recommends.
?Providers of chat boxes, email services, messaging systems, social networks, retailing sites, voice over internet protocol ad web forums must have flagging systems."
The monitoring and flagging systems would be linked to law enforcement agencies, with data shared across Europe.
The plan is likely to spark alarm among internet companies, who have long argued it would be impractical and repressive to force them to police the web. The plans call for new legislation that would force internet companies to offer filtering software as a condition of trading in the EU.
Civil rights activists warned that Clean IT, funded by a 400,000 euro grant and led by Dutch counter-terrorism officials, could mandate "vigilantism" online and a clampdown on free speech.
Joe McNamee, chief executive of the civil rights organisation EDRi " warned that the project could have unintended consequences for web users.
"I?m not a terrorist, as long as a Greek or Estonian policeman doesn?t accidentally think I?m a terrorist," he said.
"The initiative has become little more than a protection racket (use filtering or be held liable for terrorist offences) for the online security industry.
"The initial meetings, with their directionless and ill-informed discussions about doing ?something? to solve unidentified online 'terrorist' problems were mainly attended by filtering companies, who saw an interesting business opportunity.
"Their work has paid off, with numerous proposals for filtering by companies and governments, proposals for liability in case sufficiently intrusive filtering is not used."
British counter-terrorism officials have been involved in the discussions, which are due to result in final recommendations to be implemented by EU members over the next two years. They are understood to have concerns about the direction and competence of the Clean IT project.
The Office of Security and Counter Terrorism, a secretive Home Office unit, already maintains a blacklist of terrorist websites used in filtering software at universities, libraries and other public networks.
Among proposals yet "to be discussed" by the Clean IT project are measures to discourage anonymity online, under the label "real identity policies.
"Internet companies must only allow real, common names," the leaked document suggests.
"These must be entered when registering. On request of an internet company, a registrant must provide proof of the real or common name."
"Social media companies must only allow real pictures of users."
While Facebook already inists its members use their real names, Twitter has long advocated anonymity as a vital part of free speech online and resisted attempts to uncover its members' identities by American authorities investigating the Occupy protests.
Mr McNamee suggested that repressive regimes would "laugh till they choke when the EU next lectures them regarding free speech online".
