HOOK'D ON PERSONAL FINANCE: When estate planning, consider ...

???I was discussing estate planning recently and the conversation turned to wills.

????Do your estate planning documents accurately reflect who you wish to receive your assets?? I asked.

????Of course,? my client said. ?In my will I leave everything to my spouse.?

???While this thinking is common, and understandable, it?s also incorrect. Many people forget that many years earlier, maybe even before they were married, when acquiring life insurance, or enrolling in their 401(k) or 403(b) plan, or opening a traditional or Roth IRA account, they named beneficiaries in the event of their death. The same applies to brokerage accounts, bank accounts, and real estate if these assets are titled jointly with rights of survivorship.

???When a beneficiary is named or rights of survivorship exist, assets will be passed to those individuals, despite a will that might instruct otherwise. For many, the above list may comprise 95 percent or even 100 percent of their assets. If assets are designated as mentioned above, none will pass according to their will. Surprised?

???Over time, even wills that were originally coordinated properly may no longer accurately reflect a person?s current wishes. Many times, after major life events, people change their wills. However, many of them fail to change the beneficiary designations on their retirement accounts and their life insurance policies.

???Marriage, divorce, change of employment, death of a spouse, and disability are all life events that may require a change in your will and also a change in the beneficiary forms that dictate who receives them after your death. Keep in mind that the life events mentioned here do not have to be yours. A life event occurring to one of your beneficiaries may also require a change in your will as well. That is why it is important to review your will and beneficiary designation forms every time one of these life events occur.

???When wills and beneficiary instructions are not in sync, assets may not be transferred in the manner intended, even if they are passed to the correct person. Here?s an example involving retirement assets to be passed to a grandchild. Both your will and the beneficiary designation on your IRA account correctly named your grandchild as the beneficiary. While your will instructed your grandchild to receive their inheritance in trust until she reached a certain age, no such mention was made on the beneficiary designation form. In this case, the assets will pass directly to your grandchild and not in trust as you had wanted. It is even worse if the grandchild is a minor. Assets passing directly to minors come with additional restrictions on how the money can be invested, for what use the money can be used for, and only becomes the property of the grandchild once they turn the age of majority (which is 18 in New Jersey).

???Adverse income tax consequences are another bad result that can come from failing to coordinate a will with your beneficiary designation forms. Two common mistakes are not naming contingent beneficiaries on a retirement plan and not changing the beneficiary if the primary beneficiary dies first. Both of these mistakes can result in the retirement account actually having no named living beneficiary when the account holder passes away. Interestingly enough, the asset would then pass through the deceased?s will, but with potentially dire tax consequences.

???The tax code, generally speaking, requires named beneficiaries of retirement accounts to take distributions from the retirement account over their life expectancy. However, if there is no named beneficiary the account must be distributed in full within five years. For most beneficiaries this would accelerate the distributions and taxes due. In some cases, the IRS has allowed the executor of an estate to correct this after death. It?s done on a case-by-case basis, and has been disallowed many more times than it has been allowed.

???These are just a few of the many pitfalls of an uncoordinated estate plan.

Summer vacation is coming closer to an end for the students in our Valley, and for those that play sports, a new season is almost here. Whether it?s lacrosse, football, soccer or perhaps another go at baseball or softball, there is something for kids of all ages.

Of course, let?s not get ahead of ourselves as there are still quite a few recreation baseball and softball All Star teams from the Temecula Valley that haven?t quite given up on the road to the end of the Summer Championships.

The Evils Of Child Exploitation

Poverty is a very, very bad thing. Material, moral or ethical, whatever shape it comes in, poverty is dangerous. Poverty spawns discontent, envy, oppression, and more pertinently, desperation. It is a fact that 95 percent of all crime stems from one sort of poverty or the other; child exploitation is no different.

Moral poverty will lead an adult to abuse a child in any way: sexually, physically, psychologically, basically, all manner of abuse. No one with milk of human kindness in them will harm children who happen to be the most vulnerable members of our society. In Austria, recently, it was revealed that a man had locked up his own daughter in what amounted to a dungeon and systematically raped the poor child thousand of times over the decades, starting from when she was 11, and had in fact fathered eight children by her. This case is so shocking the mind can barely come with a why. My people have a saying that a man who has relationship with his own child is like a dog which vomits something and then goes back to eat it. What will motivate someone, who can only in the loosest term be called a human being, to behave in such a desperately manner? Moral poverty. When one loses the quality that makes one human, that person is no better than the animals which roam the forests.

By now you don?t need to be told that exploitation is quite simply, to use unfairly for one?s advantage. The range of abuse inherent in child exploitation is so wide and varied that it is hard to come up with a definition. For instance, there is the issue of child soldier in the war-ravaged parts of the world. Also child exploitation is the hydra-headed matter of child trafficking.

The United Nations Convention on the Rights of the Child was adopted in 1989. It proclaims that all children have the right to survival, the rights to food, the rights to family, the rights to cultural and indigenous identity and the right to education. These are the basic rights of every child, but the implementation is sadly deficient. Children are the future ? there?s no argument. You only get out what you put in. Sow the right seeds in the children in the children and they will grow up mentally, morally and totally balanced to sustain the world tainted by the shadows of residual trauma of bad childhood.

Acting Office of Management and Budget Director Jeffrey Zients (Zye-ence) said Tuesday what military leaders had been suggesting for months ? the president would exercise his authority under the budget law and spare uniformed men and women.

Zients and Deputy Defense Secretary Ashton Carter were scheduled to testify Wednesday before the House Armed Services Committee on the impending cuts.

Automatic cuts of $110 billion are slated to hit domestic and defense programs beginning Jan. 2 unless Congress can figure out a way to avert the reductions.

Employees who worry about what their co-workers are saying behind their back aren't making many friends at the office.? In fact, new research has found that workers who worry about being the subject of office gossip often invite negative behavior upon themselves.?

Not surprisingly, this happens because paranoid workers often seek to affirm their position within an organization, which in turn, causes co-workers to resent them. Not only do workers resent them, but the offending workers also increase the likelihood that they will be rejected. ? ?

"It may be best to ignore impulses that tell you that you?re the victim of office politics,? said lead author Karl Aquino, a professor at the University of British Columbia's Sauder School of Business. "However, our research shows employees should do their best to keep their interactions positive and ignore the negative. As the expression goes, kill them with kindness."

While workers may harm themselves by acting on suspicions, the research found that this kind of behavior is not abnormal because social acceptance in the workplace tends to lead to higher salaries and greater power in the workplace. That, in turn, fuels the worry that workers feel about how they are perceived within the organization. ? ??
